Partner
Cindy Yang is a partner in the Intellectual Property Group who focuses primarily on patent, trademark and copyright litigation; U.S. and foreign patent prosecution; patent interferences, oppositions and post-grant reviews; intellectual property licensing; due diligence investigations; and client counseling regarding the procurement and enforcement of intellectual property rights worldwide.

Her litigation and counseling experience involves a variety of products and technologies, including light-emitting diode modular video panels, stem cell therapies, radio frequency identification systems, workforce optimization software and services, pharmaceuticals, teleconferencing systems, light controllers, cancer vaccines, magnetic fluid conditioning systems, website builders, and plaid clothing designs.

Ms. Yang has extensive complex multidistrict and litigation experience, and represents a broad spectrum of clients before courts throughout the United States.

In addition to her intellectual property litigation and prosecution experience, Ms. Yang has negotiated and drafted license agreements, joint venture agreements, settlements of complex lawsuits, non-disclosure agreements, asset acquisition agreements and other business contracts.

Experience

Ms. Yang’s representative matters include:

Avid Identification Systems, Inc. v. Phillips Semiconductor Inc., C.A. No. 2:04-cv-183 (TWJ) (E.D. Texas). Successfully defended Swiss-based Datamars, SA and its U.S. subsidiary The Crystal Import Corp. in a patent infringement case involving RFID animal identification products. Obtained a judgment that the plaintiff’s patent was unenforceable due to inequitable conduct, the first such finding in the Eastern District of Texas.

In re Katz Interactive Call Processing Patent Litigation, C.A. No. 2:07-ML-1816 (RGK) (E.D. Texas & C.D. California). Secured a favorable settlement for Global Crossing Telecommunications, Inc. in the largest Multi-District Litigation (MDL) patent case in history involving interactive call processing and digital teleconference patents.

e.Digital Corporation v. Avid Technology, Inc., et al., C.A. No. 2:08-cv-93 (DF) (E.D. Texas). Secured a favorable settlement for Olympus America Inc. in a patent infringement case involving handheld record and playback devices with flash memory.

NMT Medical, Inc. v. W.L. Gore & Associates, Inc., C.A. No. 1:08-cv-790 (SLR) (D. Del.). Successfully represented W.L. Gore in a patent infringement case related to a medical device used to treat atrial septal defects.

Network-1 Security Solutions, Inc. v. Alcatel-Lucent USA Inc. et al., 6:11-cv-492 (LED) (E.D. Texas). Represented NEC Corporation and NEC Corporation of America in a patent infringement case involving Power over Ethernet (PoE) products and the IEEE 802 standard.

Cameron Industries, Inc. v. Walmart Stores, Inc., et al., C.A. No. 1:09-cv-6671 (DC) (S.D.N.Y.). Represented Walmart against copyright infringement claims involving fashion designs. The case settled favorably for Walmart.

Prosecuted and managed complex U.S. and foreign pharmaceutical and life sciences patent portfolios for major universities, hospitals, companies and start-up ventures.

Counseling clean-energy companies based in Asia regarding U.S./international intellectual property portfolio development, strategic business partnerships, and intellectual property acquisition and enforcement.

Conducted several patent due diligence projects for potential and actualized M&A deals which strengthened a global actionable intelligence solutions company’s leadership position in the enterprise workforce optimization market.

Previous Experience

Prior to joining Schiff Hardin, Ms. Yang was a partner in the Intellectual Property Practice of another national law firm, and earlier an associate at an intellectual property boutique law firm in New York.

Before her legal career, Ms. Yang worked as a research associate at the Brain Tumor Research Center at the University of California, San Francisco. She researched the effects of seizures and ionizing radiation therapy on the hippocampal region of the brain. She also researched brain tissue repair modalities that promote neuronal stem cell proliferation and differentiation, and the migration of newly generated neurons toward damaged areas of the brain.

In addition to her scientific background, Ms. Yang performed professionally with various modern-dance companies, physical dance theater companies and independent choreographers based in California and New York. She also cofounded a physical theater company based in San Francisco.
