Biography

David F. Abernethy concentrates his practice on the defense of products liability actions, primarily involving pharmaceutical products and medical devices and chemical products. He also handles a wide range of commercial litigation including representing insurers in coverage disputes under directors’ and officers’ and general liability policies, defending consumer class actions, and handling commercial contract, fraud and business tort cases.

Products Litigation. David has defended hundreds of products liability claims in Pennsylvania, New Jersey and other jurisdictions including numerous claims involving one of the nation’s largest makers of prescription and OTC medications and medical devices. He has extensive trial and appellate experience defending products cases involving not only pharmaceutical products and medical devices but also chemical and industrial products, electrical equipment and asbestos.

Appellate Practice. David has extensive experience prosecuting and defending appeals in products, insurance and commercial cases. He has handled numerous appeals in asbestos and products cases in Pennsylvania and New Jersey and has acted as consulting counsel for defendants appealing asbestos cases in jurisdictions around the United States. David has briefed and argued appeals in the Pennsylvania Superior Court, the U.S. Courts of Appeals for the Second, Third, Tenth and Federal Circuits, and the Utah Supreme Court. He has been appointed by the U.S. Court of Appeals for the Second Circuit to act as appellate counsel in several pro bono civil rights actions.

Insurance Coverage Litigation. David has represented a number of the country’s largest insurance carrier, at trial and in appeals in complex insurance coverage disputes, and in bad faith and extracontractual liability cases, under directors' and officers' and general liability insurance policies. These disputes have arisen from diverse underlying litigation including asbestos bodily injury and buildings claims, bodily injury claims involving contamination of blood products, environmental pollution claims, securities actions, consumer class actions and other claims.

Other Commercial Litigation. David has prosecuted and defended a wide variety of complex commercial cases. He prevailed in an arbitration proceeding on behalf of a Fortune 100 company winning the termination of a key agreement that governed one of its joint ventures and the return of control of that venture to the client, along with the millions of dollars in damages. He has defended complex fraud and breach of contract actions and litigated direct and derivative claims in a number of shareholder disputes involving closely held corporations.

In General. David graduated from Syracuse University in 1980 and from the Syracuse University College of Law in 1982, both summa cum laude. Before joining the firm he served in the United States Army Judge Advocate General’s Corps, where he gained extensive trial experience as a prosecuting attorney. David served for more than 10 years as the firm’s pro bono partner and continues to serve as a member of its Pro Bono Committee.
