Biography

Eva Cole is a litigation partner in Winston & Strawn’s New York office. Eva has significant experience representing clients facing international cartel investigations and related class actions. She has helped clients navigate the difficult web of facing multiple, simultaneous government investigations around the world and has experience defending antitrust investigations brought by antitrust authorities in the United States, Australia, Brazil, Canada, the Czech Republic, Europe, Hungary, Korea, Mexico, and New Zealand. She represents clients in both civil and criminal matters and, in addition to her representation of major U.S. and multinational corporations, she also represents individual executives facing criminal antitrust claims.

Eva also regularly represents clients in complex commercial class action and litigation, and in connection with a wide array of federal and state antitrust issues, including monopolization, price fixing, wage fixing, no-poach agreements, group boycotts, exclusive dealing, tying, price discrimination, predatory pricing, unfair competition and other restraints of trade. In addition to Eva’s experience in the antitrust context, she has also represented clients facing consumer fraud and other business tort and breach of contract claims, as well as various constitutional claims. Eva has represented clients in all stages of litigation, including appeals, and through trial.

In addition, Eva regularly advises companies with respect to antitrust compliance. Among other things, she helps companies develop antitrust compliance policies and training to help prevent antitrust problems. In particular, Eva has helped private equity funds with numerous portfolio companies and other types of corporations with multiple subsidiaries and affiliates develop comprehensive and consistent antitrust compliance programming.

Eva brings personal attention to each and every matter she handles, and clients benefit from her strategic thinking, practical approach, and efficient management of complex matters.

Experience

Antitrust Experience

In recent years, Eva's practice focuses on international cartel investigations and related class actions. Her experience extends from representing clients, both corporations and individuals, in government investigations brought by antitrust authorities around the world, including the United States, Australia, Brazil, Canada, the Czech Republic, Europe, Hungary, Korea, Mexico, and New Zealand to the civil side of cartel cases, where she represents clients in multi-district and related class actions.

Eva has also represented various companies in other types of antitrust lawsuits involving a range of federal and state antitrust claims, including numerous types of monopolization claims.

In addition, Eva regularly counsels companies with respect to antitrust compliance. Among other things, she helps companies develop antitrust compliance policies and training to help prevent antitrust problems. In particular, Eva has helped private equity funds with numerous portfolio companies and other types of corporations with multiple subsidiaries and affiliates develop comprehensive and consistent antitrust compliance programming.

Class Action and Multi-District Litigation Experience

In addition to Eva’s experience in this area in the antitrust context, she has also represented companies in consumer fraud class actions and multi-district litigations, among other types of work.

Sports and Entertainment Law Litigation Experience

Eva regularly represents NFL players in disputes with NFL clubs over player contracts and other labor issues arising under the NFL Collective Bargaining Agreement. Eva has also represented other sports and entertainment entities in suits involving constitutional, antitrust, and other issues.
