Biography

Mr. Cote represents businesses and individuals in litigation in federal and state courts throughout the country. His practice primarily includes civil rights, contracts, unfair and deceptive conduct, class action, constitutional and appellate litigation.

During his tenure with McCarter, Mr. Cote has played a leading role in obtaining several significant victories, including:

The successful defense of a former employee of Compass Group USA, Inc., one of the world’s largest food service providers, in a prisoner civil rights claim tried to a jury in the District of Arizona. The case involved a claim under the First Amendment based on an alleged failure to accommodate the prisoner’s religious dietary restrictions. The defense verdict followed a week-long trial and concluded a four-year legal battle.

The dismissal of a challenge under the public trust doctrine to the private ownership of properly-developed tidelands.

The successful defense of a large food service company in a case of first impression concerning the application and interpretation of the Massachusetts Tips Act.

A summary judgment win for an engineering and design firm in a high-profile construction accident case concerning the collapse of a coffer dam.

The dismissal of two separate lawsuits challenging the constitutionality of a toll discount program administered by the Massachusetts Turnpike Authority and the Massachusetts Department of Transportation.

Since 2009, Mr. Cote has served on the Massachusetts State Advisory Committee to the U.S. Commission on Civil Rights. Congress has directed the Commission to establish advisory committees in all 50 states and the District of Columbia to assist in its fact-finding mission. The committees receive reports and recommendations from individuals, public and private organizations, and public officials, and forward the information to the Commission.

In 2012, Mr. Cote joined the Board of BOSTnet, a non-profit organization dedicated to enriching the lives of children through the development and improvement of after-school and out-of-school educational programs.

Mr. Cote also serves as Co-chair of the Boston Lawyers Division of the Federalist Society for Law and Public Policy Studies. He is on the executive committee for the Federalist Society’s Litigation Practice Group and was the primary author of the Environmental Practice Group’s 2001 terrorism briefing paper “National Security vs. Public Disclosure: The War on Terrorism's Implications Upon Federal Emergency Planning and Right to Know Laws.”

Prior to his bar admission, Mr. Cote served as a paralegal and law clerk in Arizona, Massachusetts, Vermont and Washington, D.C. During this time, he was the principal legal assistant to the Arizona Legislature’s Ombudsman for Private Property Rights. He also clerked for the Honorable Roger J. Marzulla and Nancie G. Marzulla at Defenders of Property Rights, which, at the time, was the nation’s only non-profit legal foundation dedicated exclusively to the protection of private property rights. He is a contributing author of that organization’s 1999 publication “State Property Rights Legislation Report: Federalism in Action.”
