Biography

Michael's practice focuses on class action and appellate litigation.

Class Action Litigation. Michael defends high-profile class actions involving issues such as advertising and labeling practices, sales and billing practices, credit reporting and debt collection, telemarketing and consumer privacy. He counsels clients on all aspects of consumer class actions, including removing actions to federal court, compelling arbitration and enforcing class action waivers, coordinating multidistrict litigation, enjoining parallel proceedings, phasing certification and merits discovery, opposing class certification, conducting mock trials and jury research, negotiating settlements, designing notice and claims programs, and defending settlements from objections and collateral attack. He often writes and speaks about class actions, is a senior contributor to the TCPA Blog, and is the Chair of the Planning Committee for the American Law Institute’s Forum on Class Actions and Aggregate Litigation.

Appellate Litigation. Michael handles high-stakes appellate matters in state and federal courts across the country, often where the underlying case was handled by other counsel. His appellate work has resulted in favorable outcomes in a number of multimillion dollar cases, including rulings denying class certification, enforcing arbitration agreements, entering judgment notwithstanding a design defect verdict, absolving a manufacturer of successor liability, enforcing an exclusion of liability in an asset purchase agreement, and ordering new trials on damages and statute of limitations defenses, among others.

Consumer Contracts and Marketing. Michael counsels clients on maximizing the enforceability of their contracts and the defensibility of their marketing. He has written the terms and conditions of an affiliate of one of the country’s largest water utilities and revised the arbitration agreements and class action waivers of a leading wireless carrier, cable provider and propane supplier. He also provides practical advice on how to present and substantiate advertising claims so that they get attention from consumers rather than regulators or competitors. He has also defended numerous actions challenging telemarketing practices under the Telephone Consumer Protection Act and related statutes.

Public Interest Litigation. Michael is committed to public service. He has prosecuted several civil rights cases, enforcing the constitutional rights of prisoners and remedying racial discrimination and harassment by municipal officials and police officers. His current public interest engagements include a voting rights case challenging the certification of unreliable electronic voting machines in Pennsylvania and a disability rights case challenging the failure to provide accessible information about public benefits programs to visually-impaired residents of New York City.

In General. Michael was a managing editor for the Villanova Law Review, a recipient of the Steven P. Frankino Distinguished Service Award and a legal intern for the Hon. Dolores K. Sloviter of the U.S. Court of Appeals for the Third Circuit. He joined the firm in 2001 following a clerkship with the late Hon. James M. Kelly of the U.S. District Court for the Eastern District of Pennsylvania. He has since been named a “Lawyer on the Fast Track” (attorneys who have “worked tirelessly in their professional, personal and civic lives to improve the legal landscape and the future of others”) and inducted as a Fellow of the American Bar Foundation (an honorary organization of attorneys, judges and professors who have “demonstrated outstanding dedication to the welfare of their communities and to the highest principles of the legal profession”). He is married and has three children.

All articles are subjected to a rigorous editorial process designed to improve the article’s substance, tone, and readability. One volume is published annually, and each volume contains five issues.
