Biography

Robert Malionek is a partner in the New York office of Latham & Watkins and a member of the firm's Litigation & Trial Department. His focus is securities litigation and professional liability defense as well as debtor-side and creditor-side insolvency litigation.

Mr. Malionek has tried several cases in state and federal courts and in arbitrations, and has represented clients successfully through appeal, in a variety of areas. He frequently represents financial institutions and accounting firms in class actions, derivative actions, regulatory proceedings, arbitrations and in bankruptcy proceedings. His practice includes advising clients on financial reporting obligations. He has published many articles and chapters and given presentations to various organizations regarding securities litigation, financial disclosures and privilege issues. He publishes the twice-yearly Latham & Watkins Compendium of Securities Law.

Mr. Malionek has an active pro bono litigation practice, including in asylum, domestic violence, landlord-tenant, civil rights and school services matters. He has handled pro bono class actions, and his successful litigation against slumlords has been featured in the Los Angeles Times and Los Angeles Daily Journal.

Mr. Malionek is a member of the firm’s Ethics Committee, and he holds seminars and gives presentations in and outside the firm on issues of professional responsibility. He has served on a number of bar association ethics committees and on ABA committees and task forces, including those overseeing audit letter policy and the attorney-client privilege.

Mr. Malionek clerked for Judge Ruggero J. Aldisert on the United States Court of Appeals for the Third Circuit.

Clients on financial reporting obligations, and in defending clients in securities regulatory investigations
Debtors and various creditor constituencies through plan confirmation trial
Businesses in various other complex litigation matters, including lawsuits involving civil RICO, trade secrets and legal malpractice claims; business disputes; lender liability; employment class actions and adverse impact pattern-or-practice claims by the USDOJ; and unfair competition claims, including a class action challenge to the employment terms of all Big Four staff accountants in California
