Roger W. Patrick

Roger Patrick is an environmental lawyer whose practice includes compliance counseling, enforcement and cleanup proceedings, transactions and project development.

In the areas of compliance and enforcement, Roger advises clients with respect to CAA, CERCLA, CWA, EPCRA, NEPA, NHPA, OSHA, RCRA, TSCA, UST and climate-change strategies. Roger has managed client responses to government inspections, including multimedia investigations, and he has handled enforcement actions for alleged violations of water, air and labeling obligations. Roger also has directed client efforts to obtain or renew discharge permits and has negotiated permit terms. His hazardous waste work has covered a wide range of issues such as RCRA permitting, modification of closure plans, waste characterization, waste recycling and hazardous waste delisting.

Besides developing programs to audit compliance with air, water, waste, storage tank, reporting, emergency response and safety requirements, he has conducted audits of commercial and manufacturing facilities, including EAF steel mills and metal finishing plants. For building owners, he has helped implement asbestos-management programs. Roger’s experience with environmental disclosures ranges from “green advertising” to SEC filings to chemical warning labels.

Having supervised the investigation and remediation of properties allegedly contaminated with metals, petroleum hydrocarbons, radioactive waste, perchloroethylene and other materials, he has broad experience in advising clients about site cleanups. Roger has negotiated cleanup plans with state agencies and private parties, counseled clients on RCRA corrective action obligations and represented clients at PRP meetings and in cost-recovery actions.

For numerous corporate and real estate transactions, Roger has analyzed potential environmental risks, conducted due diligence investigations and negotiated representations, warranties, indemnities and other contract language. Furthermore, Roger has helped clients acquire brownfield sites, including BRAC property and other former DOD facilities, advised clients about environmental indemnification claims and environmental issues in bankruptcies and assessed the environmental impacts of developments and transportation projects.
