Biography

Sadik Huseny is a partner and litigator in Latham & Watkins’ San Francisco office and a member of the firm’s global Antitrust & Competition Practice. He has broad experience in antitrust, unfair competition, and complex commercial litigation, including business-to-business disputes, consumer class actions, antitrust merger challenges, and government privacy, consumer protection, and civil investigations. His practice encompasses a wide array of industries, with a particular focus on technology companies.

Mr. Huseny is dedicated to securing efficient and innovative solutions for clients facing challenges to their most important business practices and models. Whether at the pre-lawsuit or government investigation stage, at the earliest stages of litigation, or through summary judgment and full trial, he has achieved significant victories on behalf of a diverse selection of some of the world’s leading companies.

Mr. Huseny is also a strong advocate of pro bono representation for the individuals in society most in need and the organizations serving those individuals. He is currently the Chair of Latham’s San Francisco Pro Bono Committee. His direct pro bono advocacy has resulted in victories on behalf of those seeking asylum in the United States, victims of civil rights violations, and parolees seeking to reintegrate into society.

Mr. Huseny has been recognized as a “Rising Star” litigator by Superlawyers in 2013, was selected by The San Francisco Business Times as one of the few litigators in its 2013 “40 Under 40” list of innovators and leaders in the San Francisco Bay Area, and was named by The Recorder as one of its 2012 “Lawyers on the Fast Track.”

Mr. Huseny graduated from New York University School of Law magna cum laude in 2002. Prior to joining Latham, Mr. Huseny clerked for Judge Maxine M. Chesney of the US District Court for the Northern District of California.

Mr. Huseny's representitive experience includes the following:

US Airways. Representing US Airways in a consumer antitrust suit brought to enjoin the multi-billion dollar merger of US Airways and American Airlines. Successfully resisted preliminary relief motions up through the Supreme Court, allowing the merger to close.
Oracle Corporation. Representing Oracle in a contract, unfair competition and false advertising lawsuit against Hewlett-Packard regarding the Intel Itanium microprocessor.
Live Nation, Inc. Succeeded in dismissing with prejudice several purported nationwide consumer class actions alleging violations of antitrust and competition laws regarding concert ticket fees and surcharges.
Apple, Inc. Represented and achieved numerous victories for the company in a various matters.
PG&E Corporation. Represented PG&E in its complete victory, at a neutral arbitration trial, of a $5.5 billion unfair competition lawsuit brought by the California Attorney General relating to the California energy crisis.
Eaton Electrical, Inc. Obtained a summary judgment victory and subsequently resolved antitrust claims brought by independent service organizations regarding software/service policies.
ATMI Inc. Successfully defended against supply-chain exclusive dealing antitrust claims in the semiconductor fabrication industry.
Oracle Corporation. Represented Oracle Corporation as one of its trial counsel in Latham's successful defense of a lawsuit brought by the Department of Justice to enjoin Oracle’s acquisition of PeopleSoft, named by the National Law Journal as the "Top Defense Win of 2004".
Dignity Healthcare. Succeeded in the full resolution of a broad, 750,000+ class-action settlement involving allegations of unfair competition and false claims in patient billing practices.
Individual CEOs. Representation of business executives in government investigations ranging from FTC consumer protection privacy inquiries to DOJ criminal investigations, achieving significant and early dismissals.

St. Baldrick’s Foundation is created to maximize this volunteer–driven effort. The priorities: spending as little as possible to raise each dollar, and making sure every donation goes to the best research to find cures for kids fighting cancer. In its first year as an independent foundation, St. Baldrick’s continues to grow exponentially, raising more than $5.3 million. Proceeds go to the cooperative research of the Children's Oncology Group. The first St. Baldrick’s Fellow is also funded to train one of the next generation of childhood cancer researchers. St. Baldrick’s Summer Fellow awards give medical school or college students a summer to do some great research and potentially launch a new career. Also new: Our very own group of research rock stars — the Scientific Advisory Committee — is established at the second Research Priorities Summit. The first ever Pediatric Cancer Dream Team is formed.
