Biography

For almost four decades, William Devine has led private developers, landowners, energy and water providers, hotels, hospitals, universities, and other public and commercial interests in land use, environmental, and natural resource aspects of land development. He holds particularly deep knowledge and understanding of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).

From beginning to the final approval, Bill’s outsized experience and long-standing California and federal agency relationships eliminate costly steps—and missteps—in obtaining necessary local, state, and federal clearances, approvals, permits, and other entitlements for developments.

With numerous and diverse projects in his portfolio, including large-scale residential, commercial, retail, and mixed-use developments in numerous jurisdictions throughout California, he is a strategic asset for his clients. Not only is Bill able to quickly identify an optimal plan for pre-acquisition due diligence, he marshals all aspects of application and document preparation with skill and efficiency. He brings considerable value in identifying top consultants, architects, planners, traffic engineers, hydrologists, civil engineers, and others for each specific project and jurisdiction, and excels at reviewing all types of environmental reports.

If a development proposal encounters opposition, Bill is keenly aware that a practical, even-tempered approach to interactions with all parties is necessary to resolve it. But when matters escalate to full litigation, he is ready and able to pull out the stops, strategically engaging the capabilities of Allen Matkins litigators.

Scope and Depth

To date, Bill’s work has covered all of Orange County, most jurisdictions in Riverside and San Diego counties, several Los Angeles County jurisdictions, and select jurisdictions in Northern California. He has represented projects before both state and federal agencies throughout California and possesses a thorough understanding of the workings inside the Solicitor’s Office at the Department of the Interior, the U.S. Fish and Wildlife Service, the Bureau of Land Management, the Bureau of Indian Affairs, The U.S. Army Corps of Engineers, the California department of Fish and Wildlife, the State Water Resources Control Board, and a number of Regional Water Quality Control Boards.

His experience allows him to put together a strong rationale to convince others of his client’s position. He takes all possible steps to maintain and build positive relationships with cities, counties, and agencies, for which he is highly respected. He believes entitlements are obtained by working with the jurisdictions and agencies, and being open to their thoughts and ideas, rather than pushing for wrong reasons and burning critical bridges.

Sample Work

Half of Bill’s work involves CEQA, endangered species, wetlands, and cultural resource issues, such as working with Native American groups in negotiating pre-excavation agreements, master plan projects, and conservation easements.

The other half involves complex land use entitlement and permitting for large development projects. Among those, Bill worked a 15-acre, mixed-use project next to Angel Stadium in Anaheim that required sensitive operational negotiations and agreements with the team. He handled a 20-acre project in Santa Ana with 1200 residential units, retail, and affordable housing. He also represented the developer of a previously entitled 32-acre Huntington Beach mixed-use project under new development, requiring the untangling of prior restrictions and getting additional approvals from the Coastal Commission and the city.

Bill represented a successful 275-acre development of 1,800 new homes and 80,000 square feet of commercial space. The project involved state and federal government permitting and ran into many challenges, including a contentious lawsuit battle. He is also working on a hotel development near the Burbank Airport that is facing strong opposition from an adjacent landowner.
